Terms of Service

1. Basic Provisions

These Terms of Service ("Terms") govern the relationship between SportsmanApp s.r.o. ("Provider" or "we") and users of the Sportsman mobile application ("App", "Service").

By using the App, you agree to these Terms and undertake to comply with them. If you do not agree with these Terms, do not use the App.

2. Service Description

Sportsman is a mobile application and web platform designed for:

• Organizing and participating in sports events
• Connecting athletes with shared interests
• Creating and managing sports teams
• Tracking sports activities and performance
• Communication between users
• Rating and commenting on events

3. Registration and User Account

3.1 Registration Requirements

• The service is intended for persons over 16 years of age
• You must provide truthful and current information during registration
• One user may have only one account
• You are responsible for maintaining the confidentiality of access credentials

3.2 Account Types

• Basic account: free access to basic features
• Premium account: extended features for a monthly fee
• Organizer account: for organizing paid events

4. Usage Rules

4.1 Permitted Use

You may use the App only for lawful purposes in accordance with these Terms.

4.2 Prohibited Activities

It is prohibited to:

• Violate legal regulations
• Harass, intimidate or discriminate against other users
• Publish inappropriate, obscene or offensive content
• Spread spam, fraudulent or misleading information
• Use automated tools to access the App
• Attempt to breach App security
• Impersonate other persons
• Commercially exploit other users' data
• Upload malware or other malicious code

5. User Content

5.1 Content Responsibility

• You are fully responsible for all content you create or upload
• Content must not infringe third party rights
• The Provider is not responsible for user-generated content

5.2 Content License

By uploading content, you grant us a non-exclusive license to use, display and distribute it within the provision of the Service.

5.3 Content Removal

We reserve the right to remove content that:

• Violates these Terms
• Is illegal or inappropriate
• Has been reported by other users
• Threatens the security or functionality of the App

6. Sports Events

6.1 Event Organization

• Organizers are responsible for correct event information
• Organizers must have necessary permits and insurance
• The Provider is not an organizer or co-organizer of events

6.2 Event Participation

• Participants participate at their own risk
• We recommend having valid insurance
• In case of event cancellation, follow organizer's instructions

6.3 Payments and Refunds

• Event fees are paid directly to organizers
• The Provider processes payments as an intermediary
• Refund rules are set by the event organizer
• The Provider charges a commission on paid events

7. Intellectual Property

7.1 Provider's Rights

• The App and its content are protected by copyright
• Trademarks "Sportsman" and logo are our property
• You may not copy, modify or distribute our technology

7.2 Feedback

Any suggestions and feedback may be used freely by us without compensation.

8. Premium Services and Payments

8.1 Premium Subscription

• Monthly subscription: €4.99/month
• Annual subscription: €49.99/year (2 months free)
• Automatic renewal
• Can be cancelled anytime

8.2 Payment Terms

• Payments are processed through secure payment gateways
• We accept credit cards, PayPal, Google Pay, Apple Pay
• Account may be suspended for failed payments
• Prices are inclusive of VAT

8.3 Refunds

• 14-day right of withdrawal without reason
• Refunds are processed to original payment method
• Processing time: 5-10 business days

9. Limitation of Liability

9.1 Disclaimer of Warranties

• We provide no warranties for service availability
• We do not guarantee error-free operation
• We are not liable for third-party content

9.2 Liability Limitation

Our liability is limited to:

• Direct damages caused by our fault
• Maximum amount corresponding to fees paid for services in the last 12 months
• We are not liable for lost profits or indirect damages

10. Security and Data Protection

• We have implemented appropriate security measures
• Personal data is processed according to our Privacy Policy
• Report security issues to: info@sportsmanapp.cz

11. Service Termination

11.1 User Termination

• You can delete your account anytime in app settings
• Cancel Premium subscription in payment settings
• After account deletion, data will be removed according to our policies

11.2 Provider Termination

We may terminate your access for:

• Violation of these Terms
• Non-payment of fees
• Inactivity longer than 2 years
• Legal reasons

12. Changes to Terms

• We may change Terms with 30 days notice
• We will notify you of changes through the app or email
• Continued use of the service constitutes agreement to changes
• You may terminate your account if you disagree

13. Force Majeure

We are not responsible for non-performance caused by force majeure, including natural disasters, war, terrorism, pandemic, or third-party infrastructure failures.

14. Dispute Resolution

14.1 Amicable Resolution

• We strive to resolve all disputes amicably

14.2 Court Disputes

• Governing law is Czech law
• Competent courts are in Prague, Czech Republic
• Consumers may file suit in their local court

15. Final Provisions

15.1 Severability

If any provision becomes invalid, other provisions remain in effect.

15.2 Assignment

We may assign our rights and obligations to third parties. You may not assign your rights.
